7. WARRANTY

7.1. The Products are sold with a warranty in accordance with the published Warranty Policy .

7.2. The warranty applies to Products purchased from F4 Foils or from its Partners for personal use and not for resale. Partners are not authorized to modify the warranty terms or to provide any additional warranties binding the manufacturer. The warranty is non-transferable and applies only to the original retail purchaser.

7.3. The warranty does not cover:

1. improper use or use contrary to the manufacturer’s instructions;
2. incorrect installation or assembly;
3. commercial use without authorization (including rental or training activities);
4. fastening elements (e.g. screws, bolts, nuts, and washers) used for assembling the Product or for attaching it to other equipment or surfaces; such components are considered consumables and are not covered by the warranty; any damage or loss resulting from failure of fastening elements is not covered by the warranty;
5. impacts, collisions, falls, flat landings, crashes, and other incidents, whether intentional or accidental;
6. cases where the Product has been modified, altered, adapted, or integrated with third-party products, or any unauthorized changes have been made, including the use of third-party components and/or unauthorized parts;
7. transportation, loading, unloading, handling out of water, or improper storage;
8. use of the Product by users weighing more than 100 kg;
9. cases where the Product has come into contact with the seabed or bottom;
10. use in reef waves, in the wave-breaking zone, or out of water;
11. exposure to extreme temperatures, UV radiation, or direct sunlight;
12. lack of proper maintenance or improper care;
13. damage caused by water, dust, sand, wind, lightning, hail, flooding, or other natural disasters; damage caused by aggressive, improper, or excessive use, including, without limitation, use in extreme conditions or performance of tricks beyond the intended purpose and structural capabilities of the Product;
14. cosmetic defects (discoloration, scratches, dents);
15. damage caused by the use of cleaning agents other than those approved by the manufacturer;
16. use of the Product after a warranty issue has arisen;
17. removal or damage of the serial number;
18. theft or loss;
19. normal wear and tear
20. impacts or collisions with hard objects or any other irresponsible use.

7.4. The warranty period begins on the date of the original retail purchase. The original invoice serves as proof of purchase. Repaired Products shall be covered for the remaining term of the original warranty period.

7.5. F4 Foils provides a limited warranty for a period of one (1) year from the date of purchase. This limited warranty covers defects in materials or workmanship of the Product.

7.6. Products falling within the scope of the warranty shall be subject to repair or replacement if, following inspection at an authorized F4 Foils service center by a qualified warranty service technician, defects in materials or workmanship are identified. Where the damage is due to a defect in materials or workmanship, F4 Foils shall, at its sole discretion, taking into account the significance of the defect, the feasibility of replacement or repair, and whether such measures would result in disproportionately high costs for F4 Foils, repair or replace the respective Product.

7.7. F4 Foils reserves the right to determine whether a Product falls within the scope of the warranty. Normal wear and tear, cosmetic imperfections, and damage caused by improper use, modifications, negligence, or transportation are not covered by the warranty.

7.8. Damage caused during use shall not be considered a manufacturing defect.

DECLARATION

By this Declaration, I hereby declare that by purchasing, using, assembling, installing, testing, handling, or otherwise interacting with any of the products manufactured or supplied by F4 SPORTS Ltd., UIC 208188499, with its registered seat and management address at Sofia 1618, Vitosha District, 26 Ivan Susanin Street, operating under the trade name F4 Foils (“F4 Foils”), I, the undersigned user (“User”), expressly acknowledge, agree to, and accept the following terms and conditions:

I hereby declare that I am aware of and expressly acknowledge and agree that:

1. The use of the Products constitutes an activity involving a high degree of risk and includes significant and unpredictable dangers, including but not limited to: serious bodily injury; permanent disability; paralysis; loss of limbs; drowning; death resulting from injury; damage to property; or injury to third parties.

2. Such risks may arise, without limitation, from: high speeds; sharp edges; equipment malfunction or failure; natural and weather conditions; collisions; improper use or improper assembly or installation.

3. I have had sufficient opportunity to inspect the Products and to seek independent professional advice. I am in suitable physical and mental condition to use the Products, I assume full responsibility for determining their suitability, I have received training from a qualified specialist, and I possess the necessary skills and competence to use the Products safely.

4. I assume full responsibility for my own safety and for the safety of others while using the Products.

5. I acknowledge that the Products must not be used in adverse weather conditions or while under the influence of alcohol, narcotics, drugs, or medication that may impair judgment or physical ability.

6. I am familiar with and agree to comply with all applicable safety standards and safety practices each time I use the Products, including but not limited to: wearing appropriate personal flotation and protective equipment; inspecting the Products prior to use for any signs of wear or damage; checking weather conditions, water levels, tides, wind changes, and hazardous currents; maintaining a safe distance from rocks, docks, piers, pylons, swimmers, and vessels; operating within a safe distance from shore, sufficient to prevent being carried into open water; preventing use of the Products by persons who are unfamiliar with the conditions of use or who are unable to swim.

I hereby voluntarily and knowingly assume all risks, whether known or unknown, foreseeable or unforeseeable, arising from or related to the Products and their use. Furthermore, to the fullest extent permitted by applicable law, I hereby unconditionally, irrevocably, and finally release, waive, and discharge F4 Foils, as well as its owners, managers, officers, employees, contractors, designers, engineers, distributors, dealers, affiliates, and representatives (collectively, the “Released Parties”), from any and all claims, demands, actions, causes of action, liabilities, damages, losses, or expenses of any kind, whether known or unknown, foreseeable or unforeseeable, arising out of or in any way related to: the design, manufacture, testing, marketing, or sale of the Products; the use or misuse of the Products; any alleged defects, failures, or inadequate warnings; negligence, whether active or passive, of any of the Released Parties. This release and waiver applies even if the injury, damage, or loss is caused in whole or in part by the negligence of F4 Foils.

I acknowledge and agree that any modification, improper use, use of third-party components, or unauthorized repair of the Products shall immediately void any applicable warranty.

I hereby agree to defend, indemnify, and hold harmless the Released Parties from and against any and all claims, including third-party claims, damages, losses, liabilities, judgments, settlements, penalties, and legal fees arising out of or related to: my use or misuse of the Products or the use of the Products by persons to whom I have granted access; any breach of this Declaration; injury or death to myself or to any third party; property damage caused by the Products. This indemnification obligation shall survive the termination of any relationship between the parties and shall apply regardless of fault.

I expressly acknowledge that this Declaration is intended to be as broad and comprehensive as permitted by applicable law.

I hereby declare that I have carefully read and fully understood the contents of this Declaration and that I accept and sign it freely and voluntarily, with the intention of being legally bound by it.

ДЕКЛАРАЦИЯ

С настоящото декларирам, че с покупката, използването, сглобяването, инсталирането, тестването, боравенето или по какъвто и да е друг начин взаимодействието с който и да е от Продуктите, произведени или доставени от Ф4 СПОРТС ООД, ЕИК 208188499, със седалище и адрес на управление София пощенски код 1618, р-н Витоша, ул. Иван Сусанин № 26, наричан F4 Foils, аз, долуподписаният/ата потребител („Потребителят“), изрично се съгласявам със следните условия:

Декларирам, че съм запознат/а и приемам, че:

1. Използването на Продуктите представлява дейност с високо ниво на опасност и включва значителни и непредвидими рискове, включително, но не само: тежки телесни увреждания; трайна нетрудоспособност; парализа; загуба на крайници; удавяне; смърт в резултат на нараняване; щети върху имущество или вреди за трети лица.
2. Тези рискове могат да произтичат, без ограничение, от: високи скорости; остри ръбове; повреда или отказ на оборудването; природни и метеорологични условия; сблъсъци; неправилна употреба или неправилен монтаж.
3. Имал/а съм достатъчна възможност да прегледам Продуктите и да потърся независим съвет. Намирам се в подходящо физическо и психическо състояние за използване на Продуктите и нося пълна отговорност за преценката на тяхната пригодност, преминал съм обучение при квалифициран специалист и притежавам необходимите умения да ги използвам.
4. Нося пълна отговорност за собствената си безопасност и за безопасността на околните при използването на Продуктите.
5. Известно ми е, че Продуктите не трябва да се използват при лоши метеорологични условия, под въздействието на алкохол, наркотици или медикаменти.
6. Запознат/а съм със стандартите за безопасност и ще ги спазвам при всяко използване на Продуктите, в това число, без да се ограничава до: носене на лично спасително средство; проверка на оборудването преди употреба за признаци на износване или повреда; Проверка на метеорологичните условия, нивото на водата, приливите и отливите, промените във вятъра, опасни течения; спазване на безопасно разстояние от скали, кейове, пилони, плувци или плавателни съдове;  спазване на безопасно разстояние близо до брега; недопускане лица, които не са запознати с условията за използване на Продуктите, да ги използват, както и такива, които не умеят да плуват.

С настоящото доброволно и съзнателно поемам всички рискове – известни или неизвестни, предвидими или непредвидими и безусловно, неотменимо и окончателно освобождавам от отговорност и се отказвам от всякакви претенции срещу F4 Foils, както и срещу неговите собственици, управители, служители, изпълнители, дизайнери, инженери, дистрибутори, търговци, свързани лица и представители (наричани по-долу „Освободените лица“) по отношение на всички искове, претенции, съдебни действия, отговорности, вреди, загуби или разходи – известни или неизвестни, предвидими и непредвидими, произтичащи от или свързани по какъвто и да е начин с проектирането, производството, тестването, маркетинга или продажбата на Продуктите и/или използването на Продуктите, с твърдени дефекти, повреди или недостатъчни предупреждения; небрежност (активна или пасивна) на което и да е от Освободените лица. Настоящото освобождаване от отговорност се прилага и в случаите, когато увреждането или вредата е причинена изцяло или частично от небрежност на F4 Foils.

Известно ми е, че всяка модификация, неправилна употреба, използване на компоненти от трети лица или неоторизиран ремонт води до незабавно отпадане на всяка приложима гаранция.

С настоящото се задължавам да защитавам, обезщетявам и освобождавам от отговорност Освободените лица от и срещу всички искове, включително искове на трети лица, вреди, загуби, отговорности, съдебни решения, споразумения, санкции и адвокатски разноски, произтичащи от: използването или неправилното използване на Продуктите от моя страна или от лица, на които съм предоставил да ползват Продуктите; нарушение на настоящата декларация; нараняване или смърт на мен или на трети лица; имуществени вреди, причинени от Продуктите.

Това задължение остава в сила и след прекратяване на всякакви правоотношения и се прилага независимо от вината.

С настоящото изрично потвърждавам, четази декларация е съставена с цел да бъде максимално широка и всеобхватна, доколкото това е допустимо от закона.

С настоящото заявявам, че съм прочел/а внимателно и съм разбрал/а напълно съдържанието на настоящата декларация, приемам и подписвам настоящата декларация свободно и доброволно, с намерението да бъда правно обвързан/а от нея.
