DELIVERY
5.1. The Products are delivered within the territory of the Member States of the European Union (EU). F4 Foils may deliver to third countries (outside the EU) at its sole discretion on a case-by-case basis during the processing of the Client’s order, taking into account potential logistical, legal, administrative, or other obstacles or restrictions.
5.2. With respect to deliveries within the EU, the provisions of European Union law shall apply, including those governing intra-Community supplies. The price of the Products shall include value added tax (VAT) at the rate applicable on the date the order is placed.
5.3. With respect to orders for which the Client has specified a delivery address outside the territory of a Member State of the European Union, F4 Foils reserves the right to refuse delivery or to apply specific rules regarding delivery times and the charging of taxes, duties, and additional costs related to delivery, depending on the country of destination. For deliveries to third countries, VAT shall not be charged at the time the order is finalized. The Client is informed that deliveries outside the EU may be subject to customs duties, import taxes, VAT, or other governmental or local charges in accordance with the legislation of the destination country. Such taxes and charges are not included in the total order value and shall be collected by the local customs authorities upon delivery. Unless expressly stated otherwise, all customs and import duties shall be borne entirely by the Client.
5.4. With specific regard to deliveries to the United States of America, the Client is informed that, in accordance with U.S. customs regulations, all shipments to the United States must be addressed to a person with U.S. tax registration, and the shipment must include a valid Tax Identification Number (TIN), namely a Social Security Number (SSN), Employer Identification Number (EIN), or Individual Taxpayer Identification Number (ITIN). The Client acknowledges that failure to provide such information constitutes grounds for the shipment to be returned to the sender. In such cases, all costs (including, without limitation, transportation costs) related to the return of the shipment shall be borne entirely by the Client, and F4 Foils shall be entitled to deduct such costs from the amount paid by the Client for the Products.
5.5. The delivery price shall be calculated based on the selected delivery method, the Products purchased, and the country of delivery. The exact shipping cost shall be calculated upon acceptance of each specific order and shall be paid together with the price of the Products at the time the order is finalized. Delivery charges may be changed at any time without prior notice. Any such change shall take effect from the moment it is reflected on the Website. In all cases, the delivery charges applicable at the time the order is placed shall apply.
5.6. F4 Foils may cancel or refuse to fulfill a delivery in the event that:
- there is a technical and/or typing error in the prices or other Product details displayed on the Website at the time the order was placed;
- security systems indicate that the order may be fraudulent;
- there are grounds to believe that the user is a minor;
- the Product is out of stock;
- the Client has provided inaccurate, incomplete, or misleading information;
- there are suspicions of fraudulent activity, infringement of F4 Foils’ intellectual property rights, abuse of, or circumvention of these Terms;
- delivery to the specified address is not possible;
- legal or regulatory restrictions apply.
5.7. If, at the time of processing the order, F4 Foils determines that any of the Products included in the order are unavailable, F4 Foils shall use reasonable efforts to procure the Product and fulfill the order. If this is not possible, the Client shall be notified without delay.
5.8. In the event that the Client has paid the price of the Products prior to the refusal or cancellation of delivery under Clause 5.6, F4 Foils shall refund in full all amounts paid by the Client.
5.9. For the purpose of completing the delivery, F4 Foils requires the Client to provide personal data, which shall be stored in its database for the purposes of fulfilling the Client’s order and facilitating future orders through the Website. The Client’s personal data shall be stored in accordance with the Privacy Policy (link). The Client shall have the right at all times to access the personal data provided and information relating to orders placed through the Website. The Client declares that the personal data provided are accurate and true and accepts and agrees that they are fully responsible for any consequences (including additional costs) resulting from inaccuracies in the information provided that lead to confusion or errors in the delivery of the Products.
5.10. Deliveries are carried out through external courier companies selected by F4 Foils. The Client acknowledges and agrees that courier companies are independent third parties and that F4 Foils shall not be liable for delays caused by their internal processes insofar as such delays are beyond F4 Foils’ control. The Client is informed that deliveries to certain countries may be delayed due to import procedures and customs clearance. F4 Foils shall not be liable for delays resulting from customs detention or refusal of import by the competent authorities of the country of delivery.
5.11. For deliveries within the EU, the risk of accidental loss of or damage to the Product shall pass to the Client at the moment the Product is physically received by the Client or by a third party designated by the Client. The Client is informed that they must inspect the shipment prior to acceptance. In particular, upon receipt, the Client undertakes to check the integrity of the shipment and, in the event of visible damage, to notify the courier and F4 Foils. Any claims for damage must be submitted directly to the carrier immediately, at the time of delivery. In addition, the Client must notify F4 Foils within twenty-four (24) hours and provide a valid claim reference number issued by the carrier. Damage not reported within this 24-hour period shall not be covered by F4 Foils. The Client acknowledges that, in the event of a damaged shipment, such damage must be clearly noted on the shipping document (Air Waybill – AWB) with the indication “DAMAGED”.
5.12. For deliveries outside the EU, the risk of loss or damage shall pass to the Client at the moment the shipment is handed over to the courier company, unless mandatory provisions of the applicable law of the destination country provide otherwise. In the latter case, the rules applicable to deliveries within the EU, as set out above in Clause 5.11, shall apply.
5.13. In order to ensure maximum protection and safety of deliveries, F4 Foils maintains insurance coverage for risks related to the transportation of the Products. Notwithstanding the foregoing, the Client is informed that F4 Foils cannot guarantee the payment of insurance compensation in all cases, as the recognition and payment of such compensation depend entirely on the terms of the insurance contract, the rules and decisions of the relevant insurer, as well as on the timely and proper fulfillment of the requirements for submitting an insurance claim by the carrier and/or the Client. F4 Foils shall not be liable in the event that the insurer refuses to pay compensation due to non-compliance with applicable conditions, deadlines, or procedures, or due to the existence of exclusions from insurance coverage.
5.14. Delivery timeframes indicated on the Website are indicative only and depend on the country of delivery, the workload of courier companies, customs procedures, and other circumstances beyond the control of F4 Foils. F4 Foils shall not be liable for delivery delays. Notwithstanding the foregoing, expedited delivery of the Products is a priority for F4 Foils, and it uses its best efforts to ensure fast and reliable deliveries to customers worldwide by working exclusively with established and trusted carriers.
5.15. F4 Foils provides shipment tracking services, enabling the Client to monitor the progress of their shipment and receive regular updates.
5.16. Where two or more different items are purchased within a single order, each individual item shall be deemed a separate and independent Product, regardless of whether: the Products included in the same order are intended for joint use; may be assembled, installed, or integrated with one another; or form, or may form, a functional system, set, configuration, or complete technical solution. The independent nature of each Product means that separate terms shall apply to each Product with respect to delivery, risk, warranties, claims, returns, withdrawal, and liability, unless expressly stated otherwise for a specific bundle or promotional offer.
5.17. The fact that individual Products may be used in combination or as part of a common system shall not give rise to any obligation on the part of F4 Foils to guarantee their compatibility, functionality, or fitness for a particular purpose, unless expressly declared in writing.
6. RETURNS AND RIGHT OF WITHDRAWAL
6.1. The Client has the right to withdraw from the purchase and return the Product(s) purchased through the Website without stating any reason within thirty (30) calendar days from the date of dispatch.
6.2. The right of withdrawal shall be exercised by an explicit written notice to F4 Foils. In order to meet the withdrawal deadline, the notice by which the Client exercises the right of withdrawal must be sent before the expiry of the return period. Prior to returning the Product(s), the Client must contact F4 Foils’ customer support team in order to obtain a Return Merchandise Authorization (RMA) number.
6.3. All returned Products must be carefully packaged and accompanied by a duly completed shipping document. Returned Products must be in a condition allowing for resale, unused, and in their original packaging. F4 Foils does not accept returns of used or damaged Products. For the avoidance of doubt, Products that have been assembled, installed, modified, or combined with other components are not eligible for return.
6.4. The direct costs of returning the Product(s) shall be borne by the Client, including courier services, insurance, and any applicable customs duties upon re-importation. F4 Foils shall not refund any customs duties, taxes, or other governmental or local charges paid by the Client upon delivery or return of the Products.
6.5. The Client shall return the Product(s) without undue delay and no later than fourteen (14) days from the date on which the notice of withdrawal was submitted. The deadline shall be deemed met if the Products are returned before its expiry.
6.6. Upon receipt of the returned Product(s), F4 Foils shall inspect their condition and verify compliance with the return requirements. The Client shall be notified by email following completion of the inspection.
6.7. In the event of a validly exercised right of withdrawal, F4 Foils shall refund all payments received, including the costs of standard delivery (excluding any additional costs resulting from the Client’s choice of a delivery method other than the least expensive standard delivery option offered by F4 Foils). The refund shall be made using the same payment method used by the Client for the initial transaction. For the avoidance of doubt, F4 Foils shall not refund any customs duties, import taxes, VAT, or other governmental or local charges payable upon importation of the Products in accordance with the legislation of the destination country.
6.8. F4 Foils shall withhold the refund until it has received the returned Product(s) or until the Client has provided proof of return, whichever occurs first. The refund period may vary between three (3) and fourteen (14) business days from the date the returned Product(s) are received at F4 Foils’ warehouse.
6.9. F4 Foils reserves the right to review and assess any claims relating to undelivered or incomplete orders. If evidence of improper and/or fraudulent use of the Website is identified in connection with such orders, F4 Foils may refuse the refund request and suspend the Client’s account.
